Adopting Haitian Earthquake Victims

We have heard from many RainbowKids visitors who have found our website through online searches about children who may have been orphaned during the recent devastating earthquake in Haiti. Many people hear of natural disasters in various parts of the world, and want to open their homes and hearts, via adoption, to children who have lived through them. While these well intentions are commendable, it is rarely possible or advisable, at least in the short term. The reasons are simple:

1 . In the immediate aftermath of a disaster, it is often difficult to ascertain that a child is truly an orphan. Parents may have become separated from their children in the confusion and may be in another refugee camp or just over the border. It is not ethical to place a child for adoption unless it is clear that no parent able to care for that child will be found. The U.S. Citizenship and Immigration Services will not grant an orphan visa to a child unless he/she clearly meets the definition of an eligible orphan; eligible orphan status cannot be considered if there is a possibility that a parent could provide care at the country's normal standard of acceptability and did not purposely abandon or relinquish the child.

2 . Even if it is clear that a child has no parent able to care for him/her, good adoption practice requires that attempts be made to place the child with extended family, members of the community, or others in his/her birth country. Intercountry adoption is appropriate only if a child is unlikely to find a permanent, loving family in his/her birth country. In addition, children may need to be treated for post-traumatic stress disorder and international adoption may not be in their best interest at this time.

3. Ethical adoption practice requires that a child be considered legally relinquished or abandoned, and then legally adopted according to the laws of his/her country of citizenship. In the immediate aftermath of a disaster, a country's government may be in disarray and what resources are available may be deployed on projects such as providing safe water and food, caring for the injured, burying the dead, maintaining order, etc. Thus, the courts and other entities that could handle relinquishments and adoptions may not be functioning at all, or may be giving first priority to projects in other areas. Adoption cannot proceed in such an environment.

4 . In the immediate aftermath of natural or man-made disasters, an area may not be safe for travel. Occasionally, U.S. government officials who review the legitimacy of adoptions and process exit visas are unable to work safely in a country. Moreover, even if staff and families might be willing to travel, civilian air and ground transport to and within an area might be unavailable.

5 . Even if a country manages to get its legal system functioning and to identify parentless children, the process is long and thorough. The best interests of children who have been through traumatic situations is to receive immediate care within familiar surroundings. Families wishing to help children during this crisis may best do so by contributing to their loving care through a reputable charity or humanitarian group.

I am Haitian living in US. I have spent enough money in fertility trreatment now I am considering adoption and I would like to adopt from my birth country. Before the eathquake 180.000 orphans exist in Haiti with only 167 orphanage that can host no more than 150 orphans These 180.000 children are legally relinquished or abandoned like you stated. Most of them are in the orphanage years before the earthquake. Why can't we start adopting them? I don't get it.- Nick

I adopted my son internationally nearly 10 years ago. I think it's wonderful that so many people want to help Haiti's children. But as it's been stated, this is not the appropriate time for adoption. Once the chaos has subsided I hope the orphans of Haiti will find forever families. For now the best thing to do is to give money and to pray.- Adoptive Mom
isnt this an emergency?so we ned to take emergency steps.if a big fire was raging we would be very quick to put it uot with the least amont of damage ,the same responce to these kids is an emergency,no slow trickle of water(previous adoption rules)is going to put this fire out.!- jane
I am so glad you posted this. I would absolutely lose my mind if in the midst of a natural disaster here, someone took any of my four children and swept them off into another country, JUST because they couldn't find me right away. I guess I am kind of confused. My sources tell me there already were 200,000 children spread throughout Haiti BEFORE the earthquake who had been placed in orphanages. I see all those little kids and babies in desperate need of a home NOW and these people are talking about age guidelines and 20,000 dollar adoption fees!!!! There are many people that want to open their hearts, home, and families to these children. However, from what I understand, you have to be at least 35 years of age to adopt a Haitian child. To me, this seems a bit unnecessary. I was very disappointed to learn this.- Anonymous

There are many thousands of child slaves in Haiti and the Western world has closed their eyes to it for too long! It is an interesting article about adoption. One thing that many people may NOT know is that Haitians do NOT typically adopt children. Extended family are also reluctant to take in children as it is another mouth to feed and the people are so very poor. However, children are OFTEN taken in as "restavecs" - this is a French term meaning "stay with" but in essence it is a child slave.- cay

Two wonderful people have been trying to adopt 2 children from Haiti for the past year. They lived worked and helped there in one of the orphanages, had all the paper work ready then told they could not adopt as the papers were lost or never handed to the right department by someone in or connected with the orphanage. I realize that adoption is not a possibility now, but would like to add our home as one available for fostering long term or short term with possible adoption if that is the need. The 300,000 plus orphans already in Haiti prior to the earthquake should be considered to in the decision process. If you have the resources and desire to help a child in Haiti, then your best course of action would be to donate those resources to an organization helping children in Haiti. If a child has lost her family in Haiti, coping with that loss is exponentially more difficult if you remove her from everything familiar to a place incredibly foreign where nobody speaks her language.- Shawn
We would like to adopt any of the young children who lost their parents and family members in the earthquake. They have lost everything, the love & care they had from their family is now gone. Laws should be put aside during these diasters yet keep a screening process to assure they are going to a good home. My husband speaks French and was in Haiti for six months in 1995 with the US army. We would love to adopt a little boy between the ages of 3-5. We have a farm in Maine, are professionals (my husband has a law degree) and from what I am seeing we would have to wait at least three years to adopt - rubbish. Whether it is permanent or short term respite, those children cannot be left in that devastation! I know what most of the people are saying we all watch the news. and we try to understand the adoption laws but if that was your child on the street with no shelter, love, no one to take care of them and all these prisioners on the loose would like for someone to help you? In situations like this governments should try and do some thing about the laws of adoptions or fostering. I've been hearing and reading this admonition often these days, that this is not a good time to adopt from Haiti because it cannot be ascertained that the children don't have surviving relatives etc. What no one ever seems to mention is that there must be scores of children who were already officially orphaned and living in orphanages -- I read there were 380,000 orphans in Port au Prince prior to he earthquake! -- but not yet assigned to any adoptive families. It will certainly be a requirement for all prospective foster/adoptive parents to be approved (at least for foster care) through your local social services. If you really are interested, maybe you could work towards getting such approval. Then if you aren't able to help a Haitian child, perhaps you could be a foster parent to a local child who needs love and care.....whenever God closes one door he often opens another. My family and my home is also open to any child from Haiti who needs a warm, loving family, either for adoption or foster care. PLease let us know if this becomes a possibility in the near future. Our family gave to charity to help these orphans but are frustrated and afraid that our donations may not reach them in time, or at all. Like several other readers, we stand willing to foster as long as needed for 1-2 children. These are children who have emotional needs while the government works out these legal details. Haiti is only 600 miles from our coastline-such a shame that we cannot care for these children and keep them safe, even temporarily! contact if this changes - keep praying- K

I have also heard that htey are evacuating children already in orphanages in Haiti. Like in the 60's with the Cubans. If anyone know any info about how to help this by fostering or foster to adopt please post or respond. I am new to the site so sorry if i am doing this wrong. And pray for that whole nation- Luke

If a Pierre Pan airlift becomes a reality, I and many others would be willing to foster children while their government and ours determines if they have family or not. These children need to feel safe and cared for while adults figure out the details. susan- susan bush

I know we all wish that we could do more, but if a natural disaster of this magnitude happened here in America, we would not want gov't officials shipping our children off to foreign countries until they were SURE that the child had no relatives left here to care for them. My husband insisted we had to adopt in the wake of the 2004 tsunami disaster. While no children from those affected areas were available, we were led to Russia as a result and we now have two beautiful sons. There are wonderful children all over the world that need a family.- RB
